On January 11th, 2010 4 year old DeAngelo Tobia was in the care of his grandmother, 61 year old Terry Borgia and his aunt Tonina Borgia.

The boy ended up underwater in the homes bathtub.

Tonina called 911 and tried performing CPR on the child. Terry refused to help save the boy or even open the door for medical personnel.

Tobia didn’t survive.

After questioning Terry admitted she put the sleeping boy in the bathtub in his pajamas and left him unattended while the water was running. However she did not admit to drowning him.

Terry went to trial four times. The first three trials were mistrials. At the fourth trial, she was convicted of felony murder and child abuse on March 11, 2013. She was sentenced to life in prison without parole on June 12, 2013..

Tobia’s mother would express doubts about the crime saying she believes her younger sister was also involved.

Authorities didn’t have the evidence to charge Tonina with a crime and Tonina denied she was involved in the boys death.

Terry died on May 29, 2018, at the age of 69.
