Eighteen-year-old Ashley Jasmin Marmolejo, her 20-year-old brother, Angel Gomez, and their 12-year-old nephew were in Keene, Texas, on May 13, 2023.
They pulled over at a Sonic restaurant, and Gomez got out to take a leak. A 32-year-old Sonic employee, Matthew Davis, confronted Gomez.
Things between the two men became physical. Marmolejo, who was watching from the car, picked up a gun, handed it to her nephew, and told him to shoot Davis.
The preteen followed her instructions and shot Davis multiple times.
The group fled but later returned to the scene, and the 12-year-old was arrested.
Meanwhile, Davis was taken to the hospital, where he passed away.
The boy received a 12-year prison sentence for his actions.
Gomez was charged, but the case against him was dropped.
Marmolejo appeared to be on the verge of walking free, but she was indicted by a grand jury earlier this year.
She pleaded guilty to murder in October 2025. She was sentenced to 25 years in prison.
